If you worked some place can you sue if they won't pay you?

It was for one day as a hostess
I waited about two or three months and got nothing in the mail.
No check. They took my I.D. and I punched in a time card that day. The proof I have that I worked there is an email stating that I was hired for the position. I went there and I know what the office, kitchen, some of the employees look like so on and so forth. I worked for 6 hours and I also have a phone calls from them regarding the job.

If you worked, you are entitled to be paid. While I would agree that you should talk to your state Department of Labor, you would also have a claim that you could file in small claims court,
Your local labor board just LOVES to hear about employers who won't pay.

Check with the labor department in your state. They'll be able to help you get paid what you're owed, and maybe more.

If you only worked one day, you probably don't have enough value to file a suit. You can, however, report them.
You don't indicate whether you quit or were fired. If you were fired, they should have made arrangements when you left. If you quit, you should have indicated where to send final payment at the time you submitted your notice and asked when the payment would be sent.
By the way, the e-mail is not proof that you worked there, only that you were hired. They can say that you never showed up. Do you have a witness that will state that you did actually work? The punched time card is not really viable since it may have been lost, unless somehow you have a copy of it.
Yes file a claim with the District Justice office and the employer will also end up paying the court cost if you win.
If you live within driving distance to the employer,they expect you to come pick up your check.If they gave you a hat or apron,nametag etc, you will have to return their property to get your check.If you were given an employees handbook,it usually outlines company policy for picking up final checks.Read it and act accordingly.
