Someone I know signed a plea agreement in his lawyer's presence and entered it into court. The sentencing is soon, and he now has a new lawyer and is trying to change the plea. Can he do this?
Answers:
Possibly. It depends on the circumstances of the plea. For example, did his former lawyer fail to advise him properly? Did the former lawyer coerce him to sign? Or was it done freely and voluntarily without duress or coercion?
The new lawyer can try to do this if he has proper grounds, but generally it will not suceed. It's a strategy to buy time while working on the better arguments.
ask them
you have to show some valid background with a good reason for that
